A trademark objection means the Trademark Registry has examined your application and raised concerns. If you do not file a proper legal reply within 30 days of the examination report, your trademark application may be abandoned or rejected. LegalSearch's expert trademark attorneys draft and file compelling objection replies that maximise your chances of approval.
Objection replies require precise legal arguments. LegalSearch's experienced trademark attorneys draft replies that directly address each ground of objection.
Missing the 30-day reply deadline results in automatic abandonment. LegalSearch ensures your reply is filed on time, every time.
A well-drafted reply significantly increases the chances of the Registry accepting your trademark. Our success rate on objection replies is among the highest in India.
We analyse the exact nature of the objection — whether it's similarity-based, descriptiveness-based, or procedural — and craft a targeted response.
We prepare and attach all supporting documents, prior usage evidence, and legal precedents needed to strengthen your reply.
If the Registry schedules a hearing after your reply, LegalSearch provides representation and arguments before the Trademark Registrar.

Trademark objection means the Trademark Registry has examined your application and raised concerns. The Registry uploads an Examination Report and sends a letter asking for a clarification or legal reply from the applicant.
An objection is raised by the Trademark Registry's own examiner on its own findings. An opposition is raised by a third party (competitor or brand owner) who objects to the registration of your trademark after it is published in the Trade Marks Journal.
If no reply is filed within 30 days of the examination report, the Registry marks the application as Abandoned. A fresh application must then be filed, losing the original filing date and priority.
After filing the reply, the Registry typically takes 6–12 months to either accept the trademark or schedule a hearing for further arguments.
Common grounds include: the proposed mark is similar to an existing registered trademark, the mark is descriptive or generic, the mark lacks distinctiveness, or procedural deficiencies in the application.
A similarity-based objection requires arguments distinguishing your mark from the cited mark — based on differences in appearance, phonetics, meaning, and the nature of goods/services. Prior use evidence also strengthens the reply.
While possible, trademark objection replies require in-depth knowledge of trademark law and prior Registry decisions. An incorrectly drafted reply often results in rejection. LegalSearch's experts maximise your success probability.
If the Registry is not satisfied with the written reply, it schedules a hearing where the trademark owner (through their attorney) can present oral arguments before the Trademark Registrar.
LegalSearch handles trademark objection reply filing starting at Rs. 2,499. This includes legal review, drafting, filing, and acknowledgement.
After a successful reply, the trademark is accepted and published in the Trade Marks Journal for a 4-month public opposition period. If no opposition is received, the trademark is registered and the certificate is issued.
